Elections for the Administrative Council of the Bucharest International Arbitration Court (BIAC)

INVITATION TO ATTEND ELECTIONS FOR THE ADMINISTRATIVE COUNCIL OF THE BUCHAREST INTERNATIONAL ARBITRATION COURT (BIAC)

 

To whom it may concern,

It is our pleasure to notify all interested parties of the upcoming elections for the Administrative Council of the Bucharest International Arbitration Court (BIAC). In accordance with BIAC’s Organizational Regulations, updated on December 14, 2023, this serves as a formal call for submissions of applications to be considered for appointment to the Administrative Council of BIAC. The submission process shall commence on December 20, 2023 and conclude on January 22, 2024, at 17:00.

Following the closure of the submission process, the BIAC Nomination Committee will review all received applications. Those found to be free of any clerical or factual errors that may disqualify them will be forwarded to the AmCham Romania Board of Directors for final consideration and resolution regarding the appointed members. The AmCham Romania Board of Directors will convene February 15, 2024 and inform all applicants of their decision via their preferred communication channel.

Please note that, you may be invited for an interview (face-to-face or online) during the reviewing period at the discretion of the AmCham Romania Board of Directors to further discuss your vision and plans for the role of Administrative Council member.

The Administrative Council plays a pivotal role in shaping the strategic direction of BIAC and upholding the highest standards in international arbitration. We welcome applications from any candidates whose experience and expertise will contribute to the success of BIAC in this capacity.

Before expressing your interest or attending the elections, we kindly request all potential candidates to carefully review the BIAC Organizational Regulations. These regulations provide detailed information on eligibility criteria, responsibilities of Administrative Council members, and the overall election process.

Key points to consider in the BIAC Organizational Regulations include, but are not limited to:

(a) Professional Qualifications:

(i) The candidate must hold a valid and internationally recognized higher education degree;

(ii) The candidate must demonstrate having held similar steering positions in the previous 3 years prior to the candidature.

(b) Independence and Impartiality:

(i) The candidate should not have any direct or indirect financial or personal interest that could compromise their neutrality;

(ii) The candidate should not be affiliated with any other court of arbitration or organization that has a vested interest in arbitration proceedings.

(c) Availability and Commitment:

(i) The candidate must have the capacity and availability to commit at least 10 hours per calendar year and make every effort to fulfill their responsibilities as a BIAC Administrative Council member;

(ii) The candidate should be able to manage their existing professional commitments to avoid conflicts with their duties on the BIAC Administrative Council.

(d) Gender Balance:

BIAC strives to ensure gender balance among its Administrative Council members to enhance its credibility and inclusivity.

The BIAC’s Administrative Council   shall have the following competencies:

(a) provide general guidance to the activities of BIAC;

(b) supervise BIAC’s administration, budget as well as expenditures;

(c) assist with BIAC’s educational, marketing, and public relations activities;

(d) be the sole entity which shall have the right to nominate arbitrators (foreign and/or Romanian) for BIAC’s list of arbitrators pursuant to applications received in a timely manner from interested arbitrators;

(e) appoint and to remove members to the Governing Board.

Please ensure that you meet the eligibility criteria provided in the BIAC Organizational Regulations before expressing your candidacy.

For candidates interested in participating in the elections, please submit your nomination along with any required supporting documents to the BIAC Nominating Committee by January 22, 2024 at 17:00 by sending them in electronic format at the contact@bucharestarbitration.org.

List of required documents:

  1. Curriculum Vitae drafted in English outlining your education and professional background;
  2. A statement prepared in English, stating that (i) you do not have any direct or indirect financial or personal interest that could compromise your neutrality as a member of the BIAC Administrative Council and that (ii) you are not affiliated with any other court of arbitration or organization that has a vested interest in arbitration proceedings, and outlining your vision and objectives for your mandate as a member of BIAC’s Administrative Council (no more than 2 pages).
